The sum paid to the notary as an ‘advance on costs’ – commonly, though incorrectly, referred to as ‘notary’s fees’ – actually comprises:
  • Taxes,
  • Out-of-pocket expenses,
  • Administrative charges,
  • The notary’s remuneration.
This remuneration can take two distinct forms: fees or professional fees. Fees correspond to a sum calculated on the basis of a percentage and a fixed amount per formality carried out, all of which is set by government decree.

Notaries’ fees are therefore the same for all notaries in France.

This method of remuneration serves a redistributive purpose; it ensures that the fees charged for large cases cover the costs of smaller cases where the fees do not cover the actual cost of the service.

Fees, on the other hand, are set at the notary’s discretion. They apply in particular to commercial matters or for advisory services.
